II. House Bill 1004 Overview
- The Commission shall consist of:
- The Secretary of DLLR, or designee;
- The Commissioner, or designee;
- The Executive Director of the Commission on Civil Rights, or designee; and
- The following members appointed by the Governor:
- Three (3) Representatives of business in the State who have:
- Been nominated by State Business Organizations; and
- Nominated by Business Trade Associations
- Two (2) Representatives of Labor Organizations who were nominated by Labor Federations.
- Two (2) Representatives of Organizations:
- Whose objectives include elimination of pay disparity; and
- Who have undertaken advocacy, educational, or legislative initiatives in pursuit of those objectives.
- Three (3) Representatives of Higher Education or Research Initiatives:
- Who have experience and expertise collecting data on pay disparities; and
- Whose research has been used in efforts to promote the elimination of those disparities.
- Thirteen (13) total members, Chaired by a designee of the Governor.
- The Commission has six (6) legislated goals:
- Continually evaluate the extent of wage disparities in public and private sectors in the state between individuals of one race, sex, or gender and individuals of a separate race, sex, or gender;
- Establish a mechanism for the Commissioner to collect data from employers in the state, which will be used to assist the Commission in its efforts to evaluate the disparities listed in Goal 1;
- Develop a comprehensive strategy to determine and recommend best practices regarding equal pay for equal work to individuals, employers, and policymakers;
- Study and make recommendations regarding whether, and to what extent, administrative and legal remedies and processes can be streamlined and harmonized across the subtitle and other employment antidiscrimination laws;
- Develop partnerships with public and private entities to identify:
- Methods of developing a data collection mechanism;
- Effective methods of outreach through which the Commission may raise the awareness of employers about the provisions of this subtitle; and
- Potential funding sources to help the Division of Labor and Industry absorb costs associated with staffing the Commission and implementing the Commission’s charge.
- Share data and findings with the Commissioner to assist in enforcement actions under this subtitle.
- On or before December 15, 2017, and on or before December 15 of each year thereafter, the Commission shall submit a report of findings and recommendations, including any recommended legislation, to the Governor, the Senate Finance Committee, and the House Economic Matters Committee.
