SUBJECT: Adoption and Enforcement of the Revocation to 29 CFR 1910.139 – Respiratory Protection for M. Tuberculosis

A.  Background

  1. On December 31, 2003, OSHA issued a final rule revoking "Respiratory Protection for M. Tuberculosis" (29 CFR 1910.139). OSHA will apply the general industry standard for respiratory protection (29 CFR 1910.134) to respiratory protection against tuberculosis.
     
  2. On June 15, 2004, the Commissioner of Labor and Industry adopted through incorporation by reference under COMAR 09.12.31 Maryland Occupational Safety and Health Act – Incorporation by Reference of Federal Standards, the revocation of Respiratory Protection for M. Tuberbulosis (29 CFR 1910.139).

B.  Action

  1. MOSH Compliance personnel will enforce the adopted changes as provided in Attachment A.
     
  2. MOSH Supervisors will hold appropriate training sessions in each region to review the standard’s requirements.
