A. Background
- On September 12, 2002, OSHA issued a final rule amending its occupational
safety and health standard relating to signs, signals, and
barricades (29
CFR 1926.200 – 1926.203). This final rule incorporates
by reference recent amendments, additions, and revisions to
the Safety Standards for Signs, Signals, and Barricades to
require that traffic control signs, signals, and barricades
or devices protecting workers conform to Part VI of either
the 1988 Edition of the Federal Highway Administration (FHWA)
Manual on Uniform Traffic Control Devices (MUTCD), with 1993
revisions (Revision 3) (see Attachment
B) or the Millennium Edition of the FHWA MUTCD (Millennium
Edition) (see Attachment
C), instead of the American National Standards Institute
(ANSI) D6.1-1971, Manual on Uniform Traffic Control Devices
for Streets and Highways (1971 MUTCD), and to make certain
editorial changes.
- Effective January 10, 2003, the Joint Committee on Administrative, Executive,
and Legislative Review granted emergency status to the incorporation
by reference under
COMAR 09.12.31 Maryland Occupational Safety and Health
Act – Incorporation by Reference of Federal Standards, the
amendments, additions, and revisions under 29 CFR 1926.200
– 1926.203 relating to Safety Standards for Signs, Signals, and Barricades.
- On March 11, 2003, the Commissioner of Labor and Industry adopted through
incorporation by reference under COMAR 09.12.31 Maryland Occupational
Safety and Health Act – Incorporation by Reference of Federal
Standards, the amendments, additions, and revisions under
29 CFR 1926.200 – 1926.203 relating to Safety Standards for Signs, Signals and Barricades.
B. Action
- MOSH Compliance personnel will enforce the adopted changes as provided in
Attachments A,
B
and C.
- MOSH Supervisors will hold appropriate training sessions in each region to
review the standard’s requirements.
