February 2, 2018 - Laurel Park
#18-012 In the matter of Trainer Dale Capuano, regarding the Stewards Rulings #17-148 and #17-151.

On November 30, 2017, the appeal of trainer Dale Capuano was heard before the Maryland Racing Commission. The findings of the case are as follows.

The Commission hereby orders that:

  1. Because of mitigating circumstances, Trainer Dale Capuano not be fined or suspended.
  2. The horse “Six Tonsafun”, be disqualified from the fourth race on July 22, 2017 at
    Laurel Park.
  3. The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance
    with the following order:

for failure to report the proper gender of his entry “Trade the Pick” that ran on February 3, 2018.

February 10, 2018 - Laurel Park
#18-028 In the sixth race, at Laurel Park on February 9, 2018, horse #1 “Trufflesberg”, ridden by jockey, Angel Cruz was disqualified
from second position and placed third. Inside the 1/8th pole, #1 “Trufflesberg” came out, under left-handed whipping, forcing #6 “Prank Call” off his path and continued on. Closer to the finish #1 “Trufflesberg” came out into the path of #6 “Prank Call” causing his rider to check sharply to avoid clipping heels.
[Violation under COMAR 09.10.01.50, A (1)a,c, d & e, which states in pertinent parts: “A horse may not: (a) Carry another horse in or out (c) Jostle another horse (d) Intimidate another horse, or (e) Impede another horse.]

February 11, 2018 - Laurel Park
#18-029 Jockey, Angel Cruz, is suspended three (3) Maryland racing days
, February 16, 17 & 18, 2018, for riding the horse “Trufflesberg” in a careless manner in the sixth race at Laurel Park on February 9, 2018, thereby causing the disqualification of “Trufflesberg” from second to third position.
However, jockey Cruz has designated the “Wide Country” stakes, to be run at Laurel Park on February 17, 2018. The Stewards have granted his request to ride in the other Stakes that day to which he is named on; in as much as jockey Cruz will serve an additional day of suspension on February 19, 2018.

#18-030 Trainer, Jamie Ness is fined one hundred dollars ($100.00)
for not having the colors for “Myheartsinthecity”, entered to run in the first race at Laurel Park on February 11, 2018, after receiving a fine on (02/04/2018) for the same offense.

#18-031 Trainer, Sandra Dono is fined twenty-five dollars ($25.00)
for not having the colors for “Rescue Five”, entered to run in the third race at Laurel Park on February 11, 2018, after receiving a warning on (01/19/2018 ) for the same offense.

#18-032 In the matter of owners, Nichoaos Panopoulos & Sotirio Sakatis
, subject, of Steward’s Ruling #18-020
Having satisfied his financial obligation to the Maryland Thoroughbred Purse Account as of February 14, 2018, owners, Panopoulos & Sakatis are reinstated to good standing with the Maryland Racing Commission and declared eligible to participate in racing.

February 17, 2018 - Laurel Park
#18-033 Jockey, Kevin Gomez, is fined two hundred and fifty dollars ($250.)
for failure to put forth every effort in riding his mount, “Porte Cochere”, out to the finish, in the fourth race at Laurel Park on February 10, 2018.

February 19, 2018 - Laurel Park
#18-034 In the matter of owner, Suzanne Dempsey, subject, of Steward’s Ruling #18-024

Having satisfied her financial obligation to the Maryland Thoroughbred Purse Account as of February 17, 2018, owner, Dempsey are reinstated to good standing with the Maryland Racing Commission and declared eligible to participate in racing.

February 22, 2018 - Laurel Park
#18-035 Trainer, Jamie Ness is fined one hundred dollars ($100.00)
for not having the colors for “Durango Kid”, entered to run in the eighth race at Laurel Park on February 19, 2018, after receiving a fine on (02/11/2018) for the same offense.

#18-036 Trainer, Kimberly Graci is fined twenty-five dollars ($25.00)
for not having the colors for “Real Fact”, entered to run in the second race at Laurel Park on February 23, 2018, after receiving a warning on (02/17/2018 ) for the same offense.
