Subject: Clarification of Employer Duty to Provide Personal Protective Equipment and Train Each Employee
 
Effective Date: January 11, 2009
 
Issuance Date: March 16, 2009
 
Purpose: To add language to the OSHA standards clarifying that the personal protective equipment (PPE) and training requirements impose a compliance duty to each and every employee covered by an OSHA standard and that noncompliance may expose the employer to liability on a per-employee basis.

A.      Background

  1. On June 25, 2008, the Commissioner of Labor and Industry adopted, through incorporation by reference under COMAR 09.12.31 Maryland Occupational Safety and Health Act - Incorporated by Reference of Federal Standards, amendments relating to Employer Payment for Personal protective Equipment, 29 CFR Parts 1910 and 1926, and to incorporate future versions of the standard.

B.       Action

  1. MOSH compliance personnel shall enforce the amendments relating to Clarification of Employer Duty to Provide Personal Protective Equipment and Train Each Employee, 29 CFR Parts 1910 and 1926, published in the Federal Register / Vol. 73, No. 240, Friday, December 12, 2008 (FR 75568-75589) (PDF document, 136KB, download Adobe Acrobat for free).
     
  2. MOSH Compliance and Consultation Supervisors shall ensure that training sessions are conducted on the contents of this notice.
