Purpose: This Instruction adopts the OSHA National Emphasis Program (NEP) to reduce or eliminate the workplace hazards associated with the catastrophic release of highly hazardous chemicals.

Summary:

Described in the Instruction is an OSHA National Emphasis Program (NEP) for inspecting facilities with highly hazardous chemicals (HHCs) in amounts at or greater than the threshold quantities listed in 29 CFR 1910.119. Programmed inspections1 will be conducted in facilities that are known to OSHA as having a risk of catastrophic releases. Unprogrammed inspections will take place in PSM-covered facilities as described in the Instruction. This NEP does not apply to Petroleum refineries (NAICS 32411).

Action:

  1. MOSH compliance and consultation personnel, as applicable, shall follow the procedures contained in this notice when inspecting the facilities selected under this NEP. This NEP does not apply to facilities with a 32411 NAICS code.
  2. Supervisors shall ensure that this instruction is reviewed with all compliance officers and consultation staff.
  3. Wherever the OSHA Instruction references job titles, manuals, and offices, the equivalent MOSH job title, manual, or office shall apply.
  4. MOSH shall conduct 3 PSM inspections under this NEP and request a targeting list from OSHA.
  5. All NEP coding shall be consistent with this Instruction and entered into IMIS.
