RULINGS:
#22-173 On August 25, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E540069 dated July 29, 2022, contained the drug phenylbutazone at .55 mg/ml +- .06mg/ml which is in excess of the accepted threshold of .3 mg/ml phenylbutazone established by the MRC. See COMAR09.10.03.01. The Stewards, having established that blood sample #E540069 was taken from the horse “Mail Call”, owned and trained by Robert Gamber, following the running of the ninth race at Laurel Park on July 29, 2022. The Stewards notified Mr.Gamber that: (1) the presence of phenylbutazone, at this level, in the system of “Mail Call” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

The Stewards held a hearing via telephone on September 3, 2022, wherein Mr. Gamber waived his right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:
(1) “Mail Call” did carry an overage of phenylbutazone, in its system when it finished second in the ninth race at Laurel Park on July 29, 2022, a violation under COMAR 09.10.03.04,C
(2) Robert Gamber, as trainer, was the absolute insurer of, and responsible for, the condition of “Mail Call” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed.

Based upon the foregoing and taking into account mitigating circumstances, the Stewards hereby order that:

Trainer Robert Gamber be fined Five hundred ($500.00) dollars.

The horse, “Mail Call” be disqualified from the ninth race from July 29, 2022.

RULINGS:
#22-174 Jockey, Luis Batista is in violation of the HISA riding crop rule #2280 (b)(1). During the
running of the second race on September 3, 2022, jockey Batista hit his mount “Shiny Penny”
8 times which is in violation of the 6 strike rule. On September 3, 2022, Mr. Batista waived
his right for a hearing to review the race. The Stewards issued the following penalty.

(1)Mr. Batista is fined Two hundred and fifty ($250.00) dollars.
(2)Mr. Batista is suspended one (1) racing day, September 9, 2022.
(3)Mr. Batista is issued 3 points

#22-175 Trainer Anthony Farrior is fined Two hundred and fifty ($250.) for failing to have his horse “Rapid Responce” in the paddock for the sixth race on September 3, 2022 resulting in an unwarranted late scratch and a refund of all monies wagered on said horse.

RULINGS:
#22-176 Jockey, Xavier Perez is in violation of the HISA riding crop rule #2280 (b)(1). During the
running of the seventh race on September 9, 2022, jockey Perez hit his mount “Benny
Havens” 8 times which is in violation of the 6 strike rule. On September103, 2022, Mr. Perez
waived his right for a hearing to review the race. The Stewards issued the following penalty.

(1)Mr. Perez is fined Two hundred and fifty ($250.00) dollars.
(2)Mr. Perez is suspended one (1) racing day, September 16, 2022.
(3)Mr. Perez is issued 3 points

RULINGS:
#22-177 In the matter of the second race at Laurel Park on July 31, 2022;

On September 6, 2022, the Maryland Racing Commission convened to hear the appeal of owner Charles Parker. The Commission voted to uphold the Stewards decision in this matter and declared K E M Racing Stable’s “Quincy Café” the winner.
The owner of “Alottacants”, Charles Parker has accepted the decision and will not exercise his right to appeal. Therefore the official order of finish is as follows;

#22-180 In the matter of Jockeys room employee Ezequiel Rolon: On September 24, 2022 Mr. Rolon was requested to deliver a urine sample by the MRC Investigators. The specimen he rendered tested positive for THC.
COMAR 09.10.03.05 A(1)(a)(i).

A hearing was held on September 25, 2022. Mr. Rolon appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Zeke Rolon in violation of COMAR 09.10.03.05 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:

(1) That the license issued to Ezequiel Rolon be suspended until such time as he has been
professionally evaluated [COMAR 09.10.03.05, F(1)].
(2) That while he is under suspension, Mr. Rolon be denied the privileges of all the grounds
under the jurisdiction of the Maryland Racing Commission.

#22-181 In the matter of Jockeys room employee Daniel Orellana: On September 24, 2022, Mr. Orellana was requested to deliver a urine sample by the MRC Investigators. The specimen he rendered tested positive for THC.
COMAR 09.10.03.05 A(1)(a)(i).

A hearing was held on September 25, 2022. Mr. Orellana appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Daniel Orellana in violation of COMAR 09.10.03.05 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:

(1) That the license issued to Daniel Orellana be suspended until such time as he has been
professionally evaluated [COMAR 09.10.03.05, F(1)].
(2) That while he is under suspension, Mr. Orellanao be denied the privileges of all the grounds
under the jurisdiction of the Maryland Racing Commission.

#22-182 In the matter of Apprentice Jockey William Humphrey; Mr. Humphrey’s apprentice allowance was to have expired on August 4, 2022. Having provided all documentation pertinent to his injuries since his apprenticeship started, apprentice jockey Humphrey is hereby granted one hundred and twenty three (123) days of extension. This extension will now continue his apprentice allowance thru December 5, 2022.

running of the sixth race on September 25, 2022, jockey Lopez hit his mount “Tate” 10
times which is in violation of the 6 strike rule. On September 30, 2022 a hearing was held to
review the race. The Stewards issued the following penalty.

(1)Mr. Lopez is fined Five hundred dollars ($500.00).
(2)Mr. Lopez is suspended three (3) racing days, October 13, 14 and 15, 2022.
(3)Mr. Lopez is issued 5 points

RULINGS:
#22-184 In the matter of the sixth race at Pimlico Race Track on September 25, 2022, regarding the Official result.
On September 30, 2022, a hearing was held to review this race. Present for the hearing were Owner Joshua Vance, Trainer David C. Howard and Jockey Carlos E. Lopez. The Stewards reviewed the race and determined that jockey Lopez struck his mount “Tate” 10 times during the running of the race, in violation of the HISA rule of 6 strikes. According to HISA regulation, this calls for a disqualification of “Tate” from the sixth race.
Based upon the foregoing, the Stewards hereby order that:

The horse, “Tate” be disqualified from the sixth race from September 25, 2022.
The Horsemen’s Bookkeeper redistribute all monies for that race in accordance with the
following order;

#22-185 In the eleventh race at Pimlico Race Track on September 25, 2022, horse #9 “Smitten
Enough”, ridden by jockey Jose Betancourt, was disqualified from seventh position and placed
eighth. Inside the 1/8th pole, #9 while lugging in, comes over into the path of #3 “Shelly Island”
ridden by Jevian Toledo causing that horse to clip heels and fall.

COMAR 09.10.01.50 A (1)(b)(e) which states in pertinent parts: “A horse may not (b) Cross or weave in front of another horse without sufficient clearance; (e) Impede another horse;]
