RULINGS:
#22-036 In the matter of the fifth race at Pimlico Race Course on June 5, 2021;

On March 5, 2022 owner/trainer John Salzman, Jr. withdrew his appeal with the Maryland Racing Commission. The 5th race from June 5, 2021 is now declared official.

The purse monies affected by the dispute are to be released by the Horsemen's Bookkeeper.

RULINGS:
#22-037 In the matter of the first race at Pimlico Race Course on May 31, 2021;

On March 1, 2022, the Maryland Racing Commission convened to hear the appeal of trainer Richard Sillaman. The Commission voted to uphold the Stewards decision in this matter of a medication overage and subsequent disqualification of the horse “Hoss Kitten”. The trainer of “Hoss Kitten”, Richard Sillaman has accepted the decision and will not exercise his right to appeal.
The purse monies affected by the dispute are to be released by the Horsemen's Bookkeeper.

#22-038 In the matter of the third and sixth races at Pimlico Race Course on May 31, 2022;

On March 11, 2022 rainer Claudio A. Gonzalez withdrew his appeal with the Maryland Racing Commission. The 3rd and 6th races from May 31, 2021 is now declared official.

The purse monies affected by the dispute are to be released by the Horsemen's Bookkeeper.

the 1/8th pole, #1 “Going to the Lead” drifts in under a right-handed strike and bumps #9
“Hunter Joe” ridden by Johan Rosado.

#22-040 In the tenth race at Laurel Park on March 18, 2022, horse #4 “Sick Pack Sara”, ridden by
Jockey J. D. Acosta, was disqualified from fifth position and placed sixth. Inside
the 3/16th pole, #4 “Sick Pack Sara” drifts in, while lugging in, into the path of #7 “Escape
Fund” ridden by jockey Jean Alvelo moving that horse inward and into the path of #1
“Unrequited Love” ridden by jockey Carol Cedeno forcing the rider to take up sharply to avoid
clipping heels.

RULINGS:
#22-041 Jockey Grant Whitacre, is fined one thousand five hundred dollars ($1,500.00) and suspended five (5) days March 25 through March 29, 2022, for failure to ride his mount “Breviary” out to the finish in the seventh race at Laurel Park on March 18, 2022, thereby causing “Breviary” to lose a placing in the order of finish.

(Note: As per COMAR 09.10.04.05, failure to pay a fine within 48 hours from receipt of notice may result in a suspension of license.)

DATE: March 19, 2022 TRACK: Laurel Park

RULINGS:
#22-042 On January 21, 2022, the Stewards received notice from the Industrial Laboratories that blood sample #E451245, dated December 30, 2021, contained the drug D-methamphetamine which is not on the approved list of Controlled Therapeutic Substances for the Maryland Racing Commission. The Stewards established that blood sample #E451245 was taken from the horse “Miner’s Gem”, owned by Larry E. Rabold and trained by Hugh McMahon, following the running of the second race at Laurel Park on December 30, 2022. The Stewards notified Mr. McMahon that: (1) the presence of D-methamphetamine in the system of “Miner’s Gem” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing. A barn search was done by the MRC Investigators and his stable employees were drug tested.

Mr. McMahon did not exercise his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2, & 3)

A hearing was held on March 18, 2022 wherein Mr. McMahon waived his right to legal counsel.

Based upon the evidence presented before them, the Stewards find the following:
(1) “Miner’s Gem” did carry D-methamphetamine in its system when it finished first in the second race at Laurel Park on December 30, 2021, a violation under COMAR 09.10.03.04, Section C;
(2) Hugh McMahon, as trainer, was the absolute insurer of, and responsible for, the condition of “Miner’s Gem” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
(4) An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.
A positive drug test by an employee gave the Stewards cause to determine this as human contamination.

The Stewards hereby order that:

  • Because of mitigating circumstances, Trainer Hugh McMahon not be fined or suspended.
  • Mr. McMahon not be accessed any MMV points.

(3) The horse “Miner’s Gem, be disqualified from the second race on December 30, 2022 at Laurel Park.
(4) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance
with the following order:

#22-044 In the sixth race at Laurel Park on March 20, 2022, horse #8 “Stormin’ Cougar”, ridden by
Jockey Johan Rosado, was disqualified from first position and placed fourth. Inside
the 1/8th pole, #8 “Stormin’ Cougar” drifts in under a right-handed strike and crosses in front
of #3”Zealacious” ridden by Maclovio Enriquez forcing the rider to take up sharply to avoid
clipping heels. This action cost #3 “Zealacious a chance for a better placing.

RULINGS:
#22-047 On February 24, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E451536, dated February 6, 2022, contained the drug diclofenac . The Stewards established that blood sample #E451536 was taken from the horse “Linda’s Nekia”, owned by Paige Rodriguez and trained by Jesus Rodriguez, following the running of the sixth race at Laurel Park on February 6, 2022 . The Stewards notified Mr. Rodriguez that: (1) the presence of diclofenac in the system of “Linda’s Nekia” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

The Stewards held a hearing via phone on March 27, 2022, wherein Mr. Rodriguez waived his right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:

(1)“Linda’s Nekia” did have diclofenac, in its system when it finished fourth in the sixth race at Laurel Park on February 6, 2022, a violation under COMAR 09.10.03.04,C;
(2)) Jesus Rodriguez, as trainer, was the absolute insurer of, and responsible for, the condition of “Linda’s Nekia” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
(4) An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the foregoing, the Stewards hereby order:

(1)Trainer,Jesus Rodriguez be fined in the amount of Five hundred dollars ($500.00).

(2)The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance

RULINGS:
#22-059 On March 25, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E451880, dated March 11, 2022, contained the drug dexamethasone . The Stewards established that blood sample #E451880 was taken from the horse “Triple Americano”, owned by Ejetero LLC and trained by Elvis Trujillo, following the running of the fourth race at Laurel Park on March 11, 2022. The Stewards notified Mr. Trujillo that: (1) the presence of dexamethasone in the system of “Triple Americano” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

The Stewards held a hearing on March 27, 2022, wherein Mr. Rodriguez waived his right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:

(1)“Triple Americano” did have dexamethasone, in its system when it finished fourth in the fourth race at Laurel Park on March 11, 2022, a violation under COMAR 09.10.03.04,C;
