Office of Cemetery Oversight Statement on Southern Memorial Gardens Bankruptcy Filing


BALTIMORE, MD (December 14, 2011) – The Office of Cemetery Oversight (OCO), a regulatory office administered by the Maryland Department of Labor Division of Occupational and Professional Licensing, has learned that Badtec Inc., doing business as Southern Memorial Gardens (SMG) in Calvert County, has filed for Chapter 7 Bankruptcy in the United States Bankruptcy Court for the District of Maryland. The OCO released this statement today:

“The Office of Cemetery Oversight is monitoring the bankruptcy proceedings. As information becomes available, it will be posted to the SMG update on the OCO website.

“In August, the Circuit Court for Calvert County issued a cease and desist order against Badtec prohibiting the owners of the cemetery from performing or assisting in any new burials.

“Following the August court order, burials were permitted as long as they were performed by an independent contractor and the consumer had purchased a burial plot prior to August 12, 2011. It is the OCO’s hope that the bankruptcy court will allow this practice to continue.”

A meeting of creditors of Badtec, Inc. (doing business as Southern Memorial Gardens) is currently scheduled to take place at 6305 Ivy Lane, Sixth Floor, Greenbelt, Maryland 20770 on Tuesday, January 10, 2012 at 11:30 a.m. An overview of OCO’s past actions and investigations against Badtec, Inc. can be found on the OCO website.
