RULINGS:
#21-129 In the matter of Apprentice Jockey Rebecca LaBarre; Ms. LaBarre’s apprentice allowance was to have expired on July 18, 2020. Having provided all documentation pertinent to her injury of November 13, 2019, apprentice jockey LaBarre is hereby granted one hundred and fourteen (114) days of extension. With the shutdown of racing on March 20, 2020, Ms. Labarre has been granted an extension of seventy-one (71) days and with the Covid shutdown of Colonial Downs, Ms. Labarre is granted an additional fourteen (14) days. This is an extension of 199 days after her allotted 2 year period. Therefore Ms LaBarre’s apprentice allowance will now continue until February 2, 2022 or until she wins 40 races whichever occurs first.

DATE: August 14, 2021 TRACK: Pimlico Race Course

RULINGS:
#21-130 On July 2, 2021, the Stewards received notice from the Truesdail Laboratories, Inc. that blood sample #31169, dated June 5, 2021, contained the drug mepivacaine which is above LOD of mepivacaine in plasma or serum. The Stewards established that blood sample #31169 was taken from the horse “Lake Chicot”, owned by Jagger Inc. and trained by Jamie Ness, following the running of the first race at Pimlico Race Course on June 5, 2021. The Stewards notified Mr.Ness that: (1) the presence of mepivacaine at any level, in the system of “Lake Chicot” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

The Stewards held a hearing on August 13, 2021 wherein Mr. Ness waived his right to a split sample and waived his right to legal counsel. Also present at the hearing was Equine Medical Director, Dr. Libby Daniel.

Based upon the evidence before them, the Stewards find the following:

(1) “Lake Chicot” did carry mepivacaine in its system when it finished first in the first race at Pimlico Race Course on June 5, 2021, a violation under COMAR 09.10.03.04, Section C;
(2) Jamie Ness, as trainer, was the absolute insurer of, and responsible for, the condition of “Lake Chicot” at the time the horse ran (Sections D, E & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
(4) An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the evidence presented at the hearing and taking into account mitigating circumstances, the Stewards hereby order that:

  • Trainer Jamie Ness, be fined in the amount of Five Hundred dollars ($500.).
  • Trainer Jamie Ness be suspended 15 days. The suspension is stayed as long as he does not have another Class 3 violation through December 31, 2021.

(3) The horse “Lake Chicot” be disqualified from the first race on June 5, 2021 at Pimlico Race Course.
(4) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance
with the following order:

RULINGS:
#21-131 On July 12, 2021, the Stewards received notice from the Truesdail Laboratories, Inc. that blood sample #11145, dated June 20, 2021, contained the drug mepivacaine which is above LOD of mepivacaine in plasma or serum. The Stewards established that blood sample #31169 was taken from the horse “Make It a Double”, owned by Not The One Stable Inc. and trained by Linda Albert, following the running of the third race at Pimlico Race Course on June 20, 2021. The Stewards notified Ms. Albert that: (1) the presence of mepivacaine at any level, in the system of “Make It a Double” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) She had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) She had the right to be represented by counsel at the hearing.

Date: August 19, 2021 TRACK: Pimlico Race Course

RULINGS:
#21-132 In the matter of trainer Charles L. Frock:
On August 14, 2021, The Stewards held a hearing for Mr. Frock to answer a complaint made against him by the MJC concerning the welfare of a horse in his care “Derek’s Boy”and his condition prior to being sent for surgery. Attending the hearing were Equine Medical Director, Dr. Libby Daniel, Senior Association Veterinarian, Heidi Thomas and Vice President of Racing Development, Georganne Hale.

Mr. Frock appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Charles L. Frock in violation of COMAR 09.10.01.57 (K) Trainers – A trainer shall be responsible for the condition of a horse trained by him.

Accordingly, the Stewards hereby order:

That trainer, Charles L. Frock, be fined in the amount of Two thousand Five hundred dollars ($2,500.).

#21-133 In the matter of trainer Mario Serey, Jr.:
On August 15, 2021, The Stewards held a hearing for Mr. Serey to answer a complaint made against him by the MJC concerning the welfare of a horse in his care “Martini Lane” and his condition prior to being sent for surgery. Attending the hearing were Equine Medical Director, Dr. Libby Daniel, Senior Association Veterinarian, Heidi Thomas and Vice President of Racing Development, Georganne Hale.

Mr. Serey appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Mario Serey, Jr. in violation of COMAR 09.10.01.57 (K) Trainers – A trainer shall be responsible for the condition of a horse trained by him.

Accordingly, the Stewards hereby order:

That trainer, Mario Serey, Jr., be fined in the amount of One thousand hundred dollars ($1,000.).
