2009 End of Session Report

On April 7th, the Maryland General Assembly completed their work for the 2008 legislative session. During the 90-day session 2,641 bills were introduced and 747 passed. DLLR had an extremely successful session, and this report is a synopsis of the legislative issues of importance to the Department.

Budget

Operating Budget*
The General Assembly passed a $31.5 billion budget, coming in $22 million under the spending affordability guidelines and leaving cash balances of almost $1.1 billion. DLLR received a few notable items in the budget, which is for Fiscal Year 2009 and takes effect July 1, 2008.

  • Lawmakers approved four new investigators in the Division of Labor and Industry for the enforcement of living wage, prevailing wage and employment standards programs. These new positions will be instrumental as we continue to rebuild Labor and Industry's capacity to enforce worker protection laws. The budget also included an additional $22,000 to pay for investigators' travel costs.
  • The Division of Occupational and Professional Licensing received $75,000 for IT enhancements in the Design Board Cluster; $125,000 for IT enhancements, a contractual employee and new equipment for the Board of Public Accountants; and $100,000 for IT enhancements for the Home Improvement and Real Estate Commissions.
  • State employees will receive a 2% cost of living adjustment, merit increases, and a $600 deferred compensation match.
  • The Budget changed $2.3 million of funding for Financial Regulation for the regulation of banks from general funds to special funds.
  • $250,000 is included for the Division of Workforce Development for training foreign born health care workers.
  • Language is included in the budget requesting that the Department of Budget and Management review the salary structure of safety inspectors in the Division of Labor and Industry. The safety inspection unit has had persistent vacancies, and a salary reclassification will make it easier to recruit and retain qualified inspectors.

Departmental Bills

Financial Regulation

FINANCIAL INSTITUTIONS - COOPERATIVE AGREEMENTS AND INFORMATION SHARING WITH GOVERNMENT AGENCIES - HB 417*
Under this bill, the Commissioner of Financial Regulation is authorized to enter into cooperative and information-sharing agreements with other regulatory or law enforcement agencies that have authority over financial institutions. The Commissioner can exchange with an agency information about a financial institution, including information obtained during an examination. The bill takes effect July 1, 2008.

FINANCIAL INSTITUTIONS - REGULATORY REFORMS - HB 751*
This package of banking law reforms removes provisions that create a competitive disadvantage for state-chartered banks competing with federal banks.

FINANCIAL INSTITUTIONS - REGULATION, FEES, AND ASSESSMENTS - HB 752*
This departmental bill establishes a special fund to pay for the regulation of state-chartered depository institutions. All bank and credit union assessments will go into the special fund. The law also establishes new assessments and fees for depository institutions. The bill takes effect July 1, 2008.

Labor and Industry

BOILER AND PRESSURE VESSEL SAFETY - AUTHORIZED INSPECTION AGENCIES - HB 407*
The Commissioner of Labor and Industry may authorize special inspectors employed by a nationally accredited inspection agency conduct safety inspections of boilers and pressure vessels.

Occupational and Professional Licensing

MARYLAND HOME IMPROVEMENT COMMISSION - GUARANTY FUNDS - HB 409*
This bill increases the amount of money Maryland Home Improvement Commission may award a claimant for acts or omissions of a contractor from $15,000 to $20,000, and raises the maximum amount of a claim for which the Commission may issue an order without a hearing from $2,500 to be $5,000.

DESIGN BOARDS - HB 415*
This departmental bill maintains the special fund that serves DLLR's five design boards for an additional 5 years, and continues the fee-setting authority for the boards.

COSMETOLOGISTS: MAKE-UP ARTISTS - SB 144*
Under this bill, make-up artists are no longer required to be licensed by the Board of Cosmetologists.

REAL ESTATE APPRAISERS AND HOME INSPECTORS: PRE-LICENSE ED REQUIREMENTS/DISCLOSURE - SB196*
Home inspectors applicants must complete at least 72 hours of approved on-site training. Inspectors licensed by the commission must maintain general liability insurance of at least $150,000.

REAL ESTATE COMMISSION: SUMMARY SUSPENSION GROUNDS - SB181*
This emergency departmental bill authorizes the State Real Estate Commission to summarily suspend an individual's license if the licensee has been convicted of a felony, a misdemeanor related to his or her professional conduct, or any other criminal violation that contradicts real estate brokerage licensing guidelines. A licensee who fails to disclose any of the preceding convictions within 10 days of conviction or 10 days following release from incarceration is also subject to a summary suspension.

Racing

RACING COMMISSION - MILE THOROUGHBRED RACING - PAYMENT OF TAXES - SB 179*
This departmental bill extends the time within which a mile thoroughbred licensee must pay pari-mutuel taxes to the Racing Commission from 3 to 7 days after each racing day. The bill takes effect July 1, 2008.

HARNESS RACING - MARYLAND STANDARDBRED RACE FUND - SB 197*
This departmental bill repeals the requirement that the Racing Commission cancel a Maryland Standardbred Race Fund race if there are fewer than two qualified entries in the race. The bill takes effect July 1, 2008.

Unemployment Insurance

STATE COLLECTION OF THE FEDERAL UNEMPLOYMENT INSURANCE TAX - HB 416*
This departmental bill authorizes DLLR to directly collect from employers the federal unemployment insurance tax, if the U.S. Department of Labor provides states the authority to do so. Any taxes collected would be used to administer the Unemployment Insurance and Employment Services programs.

UI CLAIMS - LOWER APPEALS DIVISION - HB 432
This bill essentially codifies the division of responsibilities of DLLR's Lower Appeals Division and Board of Appeals. It establishes a Lower Appeals Division in DLLR to hear and decide appeals of unemployment insurance determinations.

UI ELIGIBILITY - VOLUNTARY QUIT TO FOLLOW A SPOUSE - HB 749
As is done in neighboring states, this bill allows spouses of military personnel to collect unemployment insurance benefits if they must leave their job to follow a spouse who has been transferred out of state. The bill requires DLLR to report to the General Assembly by June 1, 2009 regarding the fiscal impact and administration of the bill, which takes effect June 1, 2008. State expenditures to reimburse the trust fund would increase by $10,900 in FY 2009 and $16,200 in FY 2013.

Workforce Development

No "departmental" bills were introduced for the Division of Workforce Development. However, considerable time and effort went into the passage of the Administration's Adult Education bill, SB 203. More information on SB 203 is detailed in the section below: Administration Bills of Interest.

Adult Education

DLLR - CONSOLIDATION OF WORKFORCE DEVELOPMENT FUNCTIONS - TRANSFER OF ADULT EDUCATION AND LITERACY SERVICES AND EDUCATION PROGRAMS FOR CORRECTIONAL FACILITIES - SB 203*
This law transfers the administration of adult education and literacy services and correctional education to DLLR on July 1, 2009. A Workforce and Adult Education Transition Council will create a plan for a smooth transition and will report its plan to the General Assembly December 31, 2008. The transition Council will also draft a new State Plan for Adult Education. The alignment of adult education and literacy programs with our workforce one-stop system will allow Maryland to expand adult education programming and meet the workforce needs of Maryland's employers. This new alignment will serve more people through more programs; create synergies between our workforce one-stop system, community colleges, nonprofit providers, state agencies and the business community; ensure a stronger evaluation component for adult education programs and provide career development opportunities for adult education instructional and administrative staff.

Mortgage Foreclosures

Governor O'Malley introduced and the General Assembly passed a comprehensive package of bills to address the causes underlying the drastic rise in foreclosures in Maryland. Key legislative reforms include banning pre-payment penalties for mortgage loans, requiring and verifying a borrower's ability to repay a loan, and strengthening mortgage licensing requirements, including increasing the surety bond requirement and instituting a minimum net worth requirement for mortgage lender licensees.

CRIMINAL MORTGAGE FRAUD PROTECTION ACT - HB360 / SB217*
This bill creates a criminal mortgage fraud statute and provides for fines and penalties for anyone who commits mortgage fraud in Maryland. The bill gives a private right of action to victims of mortgage fraud and provides for the forfeiture and restitution of property involved in the fraud.

PHIFA ENHANCEMENT - HB361 / SB218*
By adjusting a law previously passed by the General Assembly, this bill bans foreclosure rescue transactions in Maryland and provides consumer protections for homeowners in default on their mortgages when they must sell their properties.

MORTGAGE LENDING REFORM - HB363 / SB270*
This law bans prepayment penalties for mortgage loans and requires lenders and brokers to verify a homebuyer's ability to repay a loan. The bill authorizes the Commissioner to participate in developing and implementing a multi-state automated licensing system for mortgage lenders and mortgage originators. It also strengthens the qualifications necessary to obtain a mortgage lender's license in Maryland.

FORECLOSURE PROCESS - HB365 / SB216*
Under this law, a lender may not file a foreclosure action on a residential property until 90 days after default. A notice of intent to foreclose but be sent to the homeowner 45 days before filing the foreclosure action, and the Commissioner must be notified when a notice is sent. The bill also requires personal service to the homeowner when a foreclosure action is filed, and dictates that a foreclosure sale may not occur until at least 45 days after service. The homeowner has the right to cure a default and reinstate the loan at any time up to one business day before a foreclosure sale occurs by paying all past due payments, penalties, and fees.

Impact Bills

In addition to the Administration bills of interest and DLLR departmental bills, there are a number of other bills that have implications for DLLR. These "impact" bills are highlighted below.

Apprenticeship and Training and Adult Education

CORRECTIONAL SERVICES - MARYLAND CORRECTIONAL ENTERPRISES - CONSTRUCTION SERVICES - TRAINING- HB 744*
The Commissioner of Correction at the Department of Public Safety and Correctional Services must develop training programs to provide construction and construction-related services for State correctional facilities. This bill has no direct impact on DLLR, but DLLR should ensure that these efforts are tied into the apprenticeship and workforce development systems.

STATE DEPARTMENT OF EDUCATION - ADULT EDUCATION AND FAMILY LITERACY SERVICES - SB 773*
The State Department of Education must compile an annual county-by-county list -- of adult education and family literacy services offered to the public. With the transfer of Adult Education, DLLR will be required to compile this list annually.

BRAC

HIGHER EDUCATION INVESTMENT FUND - EXPENDITURES - BASE REALIGNMENT AND CLOSURE PROCESS - HB 704*
Under this bill, initiatives addressing higher education needs related to BRAC will be eligible for funding from the Higher Education Investment Fund. This bill has no operational or fiscal impact on DLLR, but it is an important BRAC development.

Employee Protections

FLEXIBLE LEAVE ACT - HB 40
A private-sector employer who provides paid leave must allow an employee to use his or her earned paid leave to care for a sick child, spouse, or parent. DLLR is not required to enforce this law, but the department may need to be prepared to answer questions that may arise.

HB 585-NURSING HOMES - SAFE PATIENT LIFTING - HB 585*
Each nursing home in the State must establish a workgroup to examine safe patient lifting, and must develop a safe patient lifting policy to reduce employee injuries by July 1, 2009. This bill points to a need for MOSH to ensure that it has information on this important Occupational Safety and Health issue.

EMPLOYEES' RETIREMENT AND PENSION SYSTEMS - LINE OF DUTY DEATH BENEFITS - HB 725*
Members of the Employees' Retirement System, Employees' Pension System, Teachers' Retirement System, or Teachers' Pension System who are killed while performing their duties are eligible for a line of duty death benefit. The bill entitles surviving minor children and dependent parents of State employees who receive the death benefit to join the State Employee and Retiree Health and Welfare Benefits Program. The bill takes effect June 1, 2008, but applies retroactively for any State Highway Administration employee who died on or after January 1, 2007. This bill does not directly affect DLLR, but MOSH should be aware of it, particularly as it relates to its partnership with the State Highway Administration and the Occupational Safety and Health of State employees.

LABOR AND EMPLOYMENT - PAY DISPARITY DATA - REPORTING - HB 1156*
Employers must report the racial classification and gender of employees to the Commissioner of Labor and Industry, who will analyze the records to study pay disparity issues. The commissioner must report findings to the General Assembly by October 1, 2013. General fund expenditures could increase by $72,400 in FY 2009 for one administrative officer to collect and analyze the data. DLLR will assess whether additional resources or regulations are necessary

LABOR AND EMPLOYMENT - WAGE PAYMENT ON TERMINATION OF EMPLOYMENT - ACCRUED LEAVE- SB 797*
An employer is required to provide notice of leave benefits to each new employee. Upon termination of employment, an employer is not required to pay accrued leave to an employee if the employer has a written policy that limits the payment of accrued leave. The agency may need to inform its employees and update its informational packets, and this bill has a minor fiscal impact on the Division Labor and Industry.

Financial Regulation

CREDIT REGULATION - DEBT MANAGEMENT SERVICES - SB 646
This bill repeals the requirement that a licensed debt management services provider be a nonprofit entity. The bill requires the applicant to meet standards regarding debt management services. The bill also alters the requirements for a consumer education program and makes various other changes to the provisions governing debt management services businesses. The bill takes effect June 1, 2008.

CREDIT REGULATION - CREDIT GRANTOR PROVISIONS - FEES, CHARGES, AND PENALTIES - HB 852/ SB 347*
This bill allows State-chartered banks and independent mortgage lenders to continue the practice of "recapturing" loan closing costs, initially paid for by the lender, in the event that the borrower prepays the loan before a certain time. DLLR should evaluate the impact of this "Bednar" bill on its licensees and ensure that staff is familiar with its provisions.

REAL PROPERTY - PAYMENT OF INTEREST AFTER FORECLOSURE SALE - GARRETT COUNTY - HB 901/SB875
This bill adds Garrett County to the list of counties that may require the payment of interest on a mortgage or deed of trust for 60 days following a foreclosure sale or until the sale is ratified, whichever occurs first. Although this has no operational or fiscal impact on DLLR, the Division of Financial Regulation staff should be aware of the law.

CREDIT REGULATION - DEBT MANAGEMENT SERVICES - HB 947/SB 646*
This bill allows for-profit entities to become licensed debt management services providers. It also alters the requirements for a consumer education program and makes various other changes to the provisions governing debt management services. Special fund revenues could increase from licensing fees, and revenues of at least $36,000 biennially will be maintained if current licensees are able to retain their licenses because of the bill. The bill's requirements can be handled by DLLR with existing budgeted resources.

Labor and Industry

ELEVATOR SAFETY REVIEW BOARD FUND - HB 63*
This bill establishes an Elevator Safety Review Board Fund to retain fee revenues generated from licensing of elevator mechanics and contractors, registration of third-party elevator inspectors; fees charged for follow-up inspections; and fees charged for inspections in which pre-inspection criteria have not been met. DLLR may establish a funding stream for the licensing of elevator mechanics and contractors.

EMPLOYMENT AGENCIES - BONDING - ENFORCEMENT AUTHORITY - HB 866/SB 650*
The Commissioner of Labor and Industry is authorized to investigate complaints that an employment agency has failed to submit a penal bond, and establishes civil penalties for noncompliance. Because it is assumed that the bill would apply in a limited number of cases, the bill would not have a fiscal impact on DLLR. DLI will have to establish a complaint process and train staff.

BOILER AND PRESSURE VESSEL SAFETY - INSPECTIONS - ANTIQUE BOILERS OR PRESSURE VESSELS - HB 1274/ SB 840*
This bill allows certified private inspectors to perform inspections of exhibition or antique boilers or pressure vessels. The bill will apply only in a limited number of cases, and is not expected to have a fiscal impact on DLLR. DLI will need to establish an authorization process for private inspectors and train staff.

Occupational and Professional Licensing

SECONDHAND PRECIOUS METAL OBJECT DEALERS AND PAWNBROKERS - DEFINITION OF DEALER - HB 422
Under this bill, the definition of a secondhand precious metal object dealer is expanded to include individuals compensated for the sale or delivery of secondhand precious metal objects on behalf of an unlicensed party, as well as auctioneers of secondhand precious metal objects. Revenue will increase from additional Licensing fees and any penalties collected from unlicensed dealers. DLLR expenditures could increase for processing additional license applications. If licensing activity increases significantly, DLLR will need additional administrative or clerical staff to handle the workload.

REAL ESTATE SALESPERSONS - QUALIFICATIONS FOR LICENSURE - EDUCATION REQUIREMENTS - HB 566/SB 132*
This bill authorizes applicants for a real estate salesperson license to fulfill course requirements through instruction provided by remote access satellite, closed-circuit video, computer, home study, or any other approved delivery system. An increase in the number or availability of pre-application courses may require additional review by the commission. Any such increase could be handled with existing resources.

LEAD POISONING PREVENTION ACT OF 2008 - HB 589/SB 557*
This bill requires an application form for a Home Improvement license to include lead paint accreditation information. DLLR will have to adjust its licensing system to capture the additional lead accreditation information. Programming changes will cost about $5,000.

MARYLAND REAL ESTATE BROKERS ACT - VIOLATIONS AND PENALTIES - HB 626*
Under this measure, violators of the Maryland Real Estate Brokers Act are subject to increased maximum penalties, from fines of $5,000 to $25,000, and imprisonment of 1 to 3 years. Because the current penalties have rarely been invoked, the new penalty provisions are not expected to significantly affect State or local finances or operations.

MIXED MARTIAL ARTS - REGULATION BY STATE ATHLETIC COMMISSION - BOXING AND WRESTLING TAX - HB 795/SB 649
This bill creates a licensing program for individuals participating mixed martial arts contests. Additional licensing activity could increase revenue by $16,500 in FY 2009. Taxes on gross receipts from admission and telecast charges for mixed martial arts contests could also generate new revenue. General fund expenditures will increase by $12,400 in FY 2009 for contractual staff, travel, and training costs.

BUSINESS REGULATION - STATIONARY ENGINEERS - BOILERS - HB 808/ SB 622*
Under this bill, a licensed stationary engineer is not required to oversee the operation of a heating boiler. This bill does not supersede the authority of the Board of Boiler Rules to implement boiler and pressure vessel safety standards. The language clarifies the requirements for boiler oversight, and will not materially affect the State Board of Stationary Engineers' finances or operations.

CHESAPEAKE AND ATLANTIC COASTAL BAYS CRITICAL AREA PROTECTION PROGRAM - ADMINISTRATIVE AND ENFORCEMENT PROVISIONS - HB 1253*
This bill authorizes the Maryland Home Improvement Commission to deny, reprimand, suspend, or revoke home improvement licenses for failure to comply with specified requirements in the Chesapeake and Atlantic Coastal Bays. DLLR will need to establish its denial process and coordination with other agencies.

CERTIFIED PUBLIC ACCOUNTANTS - LICENSED OUT-OF-STATE CERTIFIED PUBLIC ACCOUNTANTS - PRACTICE PRIVILEGE -HB 1296*
This bill allows certified public accountants licensed in another state who meet certain standards to practice in Maryland. DLLR will need to establish a system for out of state CPAs

BUSINESS REGULATION - MOLD REMEDIATION - LICENSING - HB 1309*
Under this bill, the Maryland Home Improvement Commission will license mold remediation companies. General fund expenditures could increase by $61,900 in FY 2009 to staff the unit and develop licensing standards. General fund revenues could increase by $105,800 beginning in FY 2010 to reflect licensing fees. DLLR will establish a system for Mold Remediation Licensing.

REAL ESTATE BROKERS - RECORD KEEPING - HB 1316/SB762*
Under this bill, real estate licensees must retain copies of listings and documents pertaining to the their services for five years after the closing of a real estate transaction, or five years after the listing if the transaction is not closed. A licensee who provides property management services must keep records for five years following the termination of a management agreement. Records may be retained in electronic form, and a licensee must allow a representative of the State Real Estate Commission to inspect these records if the commission provides reasonable notice. Upon request, paper copies of a document must be provided to the commission at the licensee's expense. This bill will impact DLLR financially, but it provides additional investigatory tools.

HOME BUILDERS - SALES REPRESENTATIVE REGISTRATION AND HOME BUILDER GUARANTY FUND - HB 1557/SB 1008*
This bill repeals State Real Estate Commission licensure requirements for sales agents of home builders, and requires those sales agents instead to register with the renamed Home Builder and Home Builder Sales Representative Registration Unit. The bill also increases existing fees for registered home builders and extends certain administrative fees to Montgomery County builders who are otherwise exempted from registration requirements. The bill establishes the Home Builder Guaranty Fund to compensate claimants for an actual loss that results from an act or omission by a registrant. State Real Estate Commission revenues will decline by $6,500.

STATE BOARD OF STATIONARY ENGINEERS - LICENSING EXEMPTION - RESOURCE RECOVERY FACILITY OPERATORS - HB 1561/SB 969*
An individual who provides stationary engineer services at a resource recovery facility does not require a license from the State Board of Stationary Engineers if otherwise certified by the Maryland Department of the Environment. The Licensing Board staff will need to become familiar with the law and ensure they don't require licensing of this class of individuals.

MARYLAND INDIVIDUAL TAX PREPARERS ACT- SB 817
This bill creates the State Board of Individual Tax Preparers at DLLR, and requires the registration of individuals providing tax preparation services. Special fund expenditures could increase by $360,200 in FY 2009 to hire board staff, develop registration materials, and make programming changes. Additional special fund expenditures could result from a public awareness campaign. Registration activity could generate $125,000 in special fund revenue in FY 2009.

Task Forces, Commissions and Interim Studies

COMMISSION TO STUDY THE TITLE INSURANCE INDUSTRY IN MARYLAND - HB 600/SB61*
This bill establishes a Commission to Study the Title Insurance Industry in Maryland, jointly staffed by DLLR and the Maryland Insurance Administration. The commission will report its findings and recommendations concerning changes to title insurance laws to the Governor and the General Assembly by December 15, 2009. DLLR-related members include the Commissioner of Financial Regulation, or the Commissioner's designee; the Executive Director of the Maryland Real Estate Commission, or the Executive Director's designee.

STATE-FUNDED CONSTRUCTION PROJECTS - APPRENTICES - HB 1155
Although it was referred to interim study, this bill would have required construction contractors who work on projects that receive State funds to have an approved and registered apprenticeship program and to hire one registered apprentice for every three journeypersons. DLLR should offer to work on the interim study to ensure that the apprenticeship system is represented.

CREDIT REGULATION - DEBT SETTLEMENT AND DEBT MANAGEMENT SERVICES PROVIDERS - HB 1223
Although it was referred to interim study, the bill adds debt settlement services to the services currently licensed and regulated by the Commissioner of Financial Regulation under the Maryland Debt Management Services Act. Debt settlement services providers will be subject to the existing licensing, examination and regulatory requirements that currently apply to debt management services providers. DLLR should participate in the interim study.

TASK FORCE TO STUDY HOW TO IMPROVE FINANCIAL LITERACY IN THE STATE - HB 1242/SB 533*
This bill establishes a Task Force to Study How to Improve Financial Literacy in the State. The task force will report its findings and recommendations to the Governor and the General Assembly by December 1, 2008. The Commissioner of Financial Regulation, or her designee, is a member of this Task Force.

TASK FORCE TO STUDY THOROUGHBRED RACING AT ROSECROFT RACEWAY - HB 1506*
This bill creates a Task Force to study thoroughbred racing at Rosecroft Raceway. The panel will be staffed by DLLR, and will recommendation actions regarding the future of Rosecroft Raceway. Task force recommendations will be submitted to the Governor and the General Assembly by December 31, 2008. DLLR will make recommendations on Task Force membership.

COMMISSION TO STUDY THE IMPACT OF IMMIGRANTS IN MARYLAND - HB 1602*
This bill establishes a Commission to Study the Impact of Immigrants in Maryland. The commission will report its findings to the Governor and the General Assembly by January 1, 2011. In developing its findings for the report, the commission is required, to distinguish between legal immigrants and those who are not in lawful immigration status. The DLLR Secretary, or his designee, is a member of the Commission.

Miscellaneous

PROCUREMENT - PREFERENCES - EMPLOYMENT WORKS PROGRAM - HB 805/SB 368
This bill establishes the Employment Works Program within the Department of General Services. The Secretary of General Services must designate Maryland Works, Inc., or another appropriate entity, to facilitate the distribution of procurement contracts to community service providers that participate in Employment Works. The DLLR Secretary or his Designee is named as a member of the Pricing and Selection Committee for the Program.

GOVERNMENT EFFICIENCY AND STREAMLINING OPERATIONS - HB 865*
Under this measure, units of State government and all local government entities must publish notices of procurements and procurement awards on eMaryland Marketplace (eMM). The requirement covers contracts procured through competitive sealed bidding, competitive sealed proposals, and noncompetitive negotiations. This bill authorizes Worcester County or a municipality in Worcester County to grant a property tax credit for a historically operated amusement park. This bill has no operational or fiscal impact on DLLR, but it is of extreme importance to the amusement parks in Ocean City and thus impacts amusement ride safety in the state.

WORKERS' COMPENSATION - COVERED EMPLOYEES - STATE GOVERNMENT VOLUNTEER WORKERS - HB 1400*
Under this bill, a volunteer worker for a unit of State government is a covered employee under the Maryland Workers' Compensation Law. Coverage for a volunteer worker is limited to medical benefits and does not provide for disability or lost income. As DLLR moves toward using volunteers, it is important to understand the impact of this legislation.

This bill allows Worcester County or a municipality in Worcester County to grant a property tax credit for the Ocean City Amusement and Fishing Pier and any other area of at least 30 acres located in Ocean City or west of Route 528 and used for the operation of an amusement park. This bill has no operational or fiscal impact on DLLR. However it is of extreme importance to the two major ride owners in Ocean City and thus impacts amusement ride safety in the state.
