Notice of Proposed Action

The Board of Plumbing proposes to adopt new Regulation .03
under COMAR 09.20.01 State Plumbing Code. This action was
considered by the State Board of Plumbing at a public meeting held
on February 16, 2012, notice of which was given by publication in
39:2 Md. R. 231 (January 27, 2012), pursuant to State Government
Article, §10-506(c), Annotated Code of Maryland. Because
substantive changes have been made to the original proposal as
published in 39:1 Md. R. 26 . 27 (January 13, 2012), this action is
being reproposed at this time.
Statement of Purpose
The purpose of this action is to provide standards for the
implementation of Business Occupations and Professions Article,
§12-605.1, Annotated Code of Maryland, which became effective
January 1, 2012. This section requires that those installing or
repairing plumbing materials that are intended to dispense water for
human consumption use only lead-free materials.
In response to public comments received following the publication
of the original proposal, in this reproposal the Board has modified
COMAR 09.20.01.03E (1), (2), and (3) to clarify the water supply
system components affected and has added §F(2) and modified §F(3)
to include bar sink faucets and private bathroom sink faucets among
the water supply system piping that is intended to dispense water for
human consumption in the proposed regulation.
Comparison to Federal Standards
There is a corresponding federal standard to this proposed action,
but the proposed action is not more restrictive or stringent.
Estimate of Economic Impact
The proposed action has no economic impact.
Economic Impact on Small Businesses
The proposed action has minimal or no economic impact on small
businesses.
Impact on Individuals with Disabilities
The proposed action has no impact on individuals with disabilities.

Open Meeting
Final action on the proposal will be considered by the Board of
Plumbing during a public meeting to be held on July 19, 2012 at
10:30 a.m., at 500 N. Calvert St., Third Floor Conference Room,
Baltimore, MD 21202.
