July 2018 Thoroughbred Rulings - Maryland Racing Commission

July 1, 2018 - Laurel Park
#18-093 Trainer, Wendy Uhacz is fined twenty-five dollars ($25.00) for not having the colors for “Orenda”, entered to run in the first race at Laurel Park on June 30, 2018, after receiving a warning on (06/17/2018 ) for the same offense.
THIS IS A VIOLATION OF: [COMAR 09.10.01.09] which states in part……
“It shall be the sole responsibility of the trainer to see that his or her owner’s colors are in the
jockey’s quarters to be used for his or her respective entries, failure to do so, the trainer will be subject to fine”.

July 15, 2018 - Laurel Park
#18-094 On July 9, 2018, the Stewards received notice from Truesdail Laboratories, Inc., that blood sample #27258, dated June 24, 2018, contained the drug methocarbamol at a level of 9.25+- 0.21 ng/ml
, which is in excess of the accepted threshold level of 1 ng/ml of plasma. The Stewards, have established that blood sample #27258 was taken from the horse “Lunar Boogie”, owned and trained by Patrick F. Nuesch, following the running of the fourth race at Laurel Park on June 24, 2018. The Stewards notified Mr. Nuesch that: (1) the presence of methocarbamol at this level in the system of “Lunar Boogie” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

Mr. Nuesch did not exercise his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2, & 3)

The Stewards held a hearing via phone on July 14, 2018. Mr. Nuesch waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:

  1. Lunar Boogie”, did carry an overage of methocarbamol in its system when it finished second in the fourth race at Laurel Park on June 24, 2018, a violation under COMAR 09.10.03.04, Section C;
  2. Patrick F. Nuesch, as trainer, was the absolute insurer of, and responsible for, the condition of “Lunar Boogie” at the time the horse ran (Sections D, E & F)

Based upon the foregoing, and in accordance with COMAR 09.10.03.04;

Stewards hereby order that:

Trainer Patrick F. Nuesch be fined five hundred dollars ($500.00). 09.10.01.45 V (1) (d)

A separate hearing was held concerning the Multiple Medication Violation Point System

Trainer Patrick F. Nuesch be accessed one-half (1/2) point.

July 20, 2018 - Laurel Park
#18-095 Trainer, Noah Abramson is fined twenty-five dollars ($25.00)
for not having the colors for “Cut Time”, entered to run in the second race at Laurel Park on July 15, 2018, after receiving a warning on (07/01/2018 ) for the same offense.
THIS IS A VIOLATION OF: [COMAR 09.10.01.09]

July 21, 2018 - Laurel Park
#18-096 In the matter of stable employee Jonathan Reyes-Medina.
: On July 20, 2018 Mr. Reyes-Medina was interviewed by the MRC Investigators about drug use on the grounds. Mr. Reyes-Medina admitted to marijuana use. Mr. Reyes-Medina refused a request for a urine sample.
COMAR 09.10.03.05 A(1)(i).

A hearing was held, Mr. Reyes-Medina appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Jonathan reyes-Medina in violation of COMAR 09.10.03.03 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:

  1. That the license issued to Jonathan Reyes-Medina be suspended until such time as he has been
    professionally evaluated [COMAR 09.10.03.05, F(1)], and
  2. That while he is under suspension, Mr. Reyes-Medina be denied the privileges of all the grounds under the jurisdiction of the Maryland Racing Commission. [COMAR 09.10.01.45, 'Y (1) (a).]

#18-097 The below listed licensees have been fined
for failure to have the 2017-18 license badges they had been issued by the Maryland Racing Commission.

#18-098 In the sixth race, at Laurel Park on July 20, 2018, horse #4 “Joe’s Gift”, ridden by apprentice jockey, Pablo Rodriguez was disqualified
from first position and placed second. Inside the 1/16th pole, #4 “Joe’s Gift” under right-handed whipping, came over into the path of #5 “Baltimore Street” bumping him repeatedly, forcing the rider to check sharply.
[Violation under COMAR 09.10.01.50, A (1) c, d & e , which states in pertinent parts: “A horse may not: (c) Jostle another horse (d) Intimidate another horse, or (e) Impede another horse.]

#18-099 Apprentice Jockey, Pablo Rodriguez, is suspended three (3) Maryland racing days
, July 26, 27 & 28, 2018, for riding the horse “Joe’s Gift” in a careless manner in the sixth race at Laurel Park on July 20, 2018, thereby causing the disqualification of “Joe’s Gift” from first to second position.
COMAR 09.10.01.45 AA(1).

#18-100 On June 7, 2018, the Stewards received notice from Truesdail Laboratories, Inc. that blood sample #18637, dated May 28, 2018, contained the drugs flunixin at 3.7+-0.2 ng/ml and phenylbutazone at 0.6mg/ml
which, in combination, is in excess of the accepted threshold level of 3.0 flunixin and 0.3 phenylbutazone established by the MRC for this combination. See COMAR 09.10.03.01. The Stewards, having established that blood sample #18637 was taken from the horse “Troublesome”, owned by Emcee Stable, LLC and trained by Charles Lynch, following the running of the third race at Pimlico Race Course on May 28, 2018. The Stewards notified Mr. Lynch that: (1) the presence of flunixin and phenylbutazone in the system of “Troublesome” at these levels constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

Mr. Lynch exercised his right to the split sample testing.

Upon receiving conformation from Texas A&M Veterinary Medical Diagnostic Laboratory that flunixin and phenylbutazone were present in sample #18637 dated May 28, 2018, at a quantity level of flunixin 3.3+-0.2 ng/ml and phenylbutazone at 0.35+-0.2mg/ml., The Stewards held a hearing on this matter July 22, 2018, wherein Mr. Lynch waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:

  1. Troublesome” did carry an overage of flunixin and phenylbutazone, in its system when it finished second in the third race at Pimlico Race Course on May 28, 2018, a violation under COMAR 09.10.03.04,C;
  2. Charles Lynch, as trainer, was the absolute insurer of, and responsible for, the condition of “Unbridled Escape” at the time the horse ran (Sections D & F);

Based upon the foregoing, the Stewards hereby order that:

Trainer Charles Lynch, be fined in the amount of Five Hundred dollars ($500.).

A separate hearing was held to address the Multiple Medication Violation Point system.

Trainer Charles Lynch will be assigned one-half (1/2) Multiple Medication Violation Point.

#18-101 Trainer, Ronald Rideout is fined Five Hundred ($500.)
for submitting an unwarranted scratch on his horse “Rowd E Allie”, entered to run in the eighth race at Laurel Park on July 26, 2018.

July 27, 2018 - Laurel Park
#18-102 Jockey, Wilfredo Corujo, is fined One Hundred dollars ($100.)
for, failure to fulfill his riding
engagement on July 22, 2018.
