REVOCATIONS
2005-RE-098 - Dina M. Leone (Salesperson, Coldwell Banker Residential
Brokerage) License REVOKED and Licensee FINED
$25,000 for violation of § 17-322(b)(3), (4), (14), (22),
(25), (31), (32), and (33) and §§ 17-502 and 17-532 and
COMAR 09.11.02.01C and 09.11.02.02A for willfully making
misrepresentations and false promises, failing to disclose
material facts, failing to furnish a copy of the contract
to the buyer, failing to account for monies in the licensee's
possession that belonged to others, converting trust monies
to her own use, failing to protect and promote the interests
of the buyer, and failing to protect the public against
fraud, misrepresentation, and unethical practices. A Guaranty
Fund award in the amount of $11,500 was made as a result
of the conduct of the licensee.
2005-RE-049 - Dina M. Leone (Salesperson, Coldwell Banker Residential
Brokerage) License REVOKED and Licensee FINED
$15,000 for violation of § 17-322(b)(1), (3), (25), and
(33) and COMAR 09.11.02.01C and 09.11.02.02F for obtaining
her real estate license through fraud or deception, willfully
making misrepresentations and false promises, and engaging
in conduct that demonstrated bad faith and untrustworthiness
and that constituted dishonest, fraudulent, or improper
dealings. A Guaranty Fund award in the amount of $25,000
was made as a result of the conduct of the licensee.
2004-RE-222 & 223 - Ronald E. Rollins (Salesperson, Celebrity
Associates Real Estate Services, Inc.) License REVOKED
and Licensee FINED $5,000 for violation of § 17-322(b)(14),
(21), (22), (25), and (33) and COMAR 09.11.02.01C and 09.11.02.02A
for failing to deliver a copy of a real estate contract
to the parties within a reasonable period of time, accepting
a commission or other valuable consideration from someone
other than the real estate broker with whom the licensee
was affiliated, failing to account for and remit promptly
funds that he obtained from the buyers, obtaining monies
from the buyers under false pretenses, engaging in conduct
that demonstrated bad faith and untrustworthiness and that
constituted improper dealings, and failing to promote the
interests of his clients. A Guaranty Fund award in the amount
of $1,150 was made as a result of the conduct of the licensee.
2005-RE-206 - Gary Lee Russell (Associate Broker, K.B.B. Properties)
License REVOKED and Licensee FINED $5,000
for violation of § 17-322(b)(1) and (25) for failing to
reveal a criminal conviction on his application renewal.
LICENSE SUSPENSIONS
2005-RE-120 - Yolanda Abney (Salesperson, Long & Foster
Real Estate, Inc.) License SUSPENDED under § 17-412(a)
until repayment of a Guaranty Fund Award of $1,230.
2005-RE-235 - Cornell Garrison (Salesperson, Michaels Realty,
Inc.) agreed to a sixty-day SUSPENSION of his license,
a FINE OF $3,000, and completion of a course in
real estate ethics in addition to the course hours required
for the renewal of his license, for violation of § 17-322(b)(4),
(22), (25), and (33) and COMAR 09.11.02.01C by not naming
the true owner of the property on the contract of sale,
failing to place the deposit monies in an escrow account,
requiring the buyer to use a specific mortgage company,
failing to advise the buyer that he was an officer of that
company, and giving the buyer a check for the return of
his deposit that was returned by the bank for insufficient
funds.
2004-RE-221- Ronald E. Rollins (Salesperson, Celebrity Associates
Real Estate Services, Inc.) License SUSPENDED for
one year and Licensee FINED $12,000 for violation
of §17-322(b)(14), (15), (21), (22), (25), and (32) and
COMAR 09.11.02.01C for failing to furnish copies of contracts
of sale, failing to retain copies of contracts of sale,
failing to account for and remit trust monies, failing to
advise his broker of real estate transactions he was handling
for third parties, engaging in conduct that demonstrated
untrustworthiness and that constituted improper dealings,
and failing to protect the public against fraud or unethical
practices in the real estate field.
2004-RE-212 - Mary Ann O'Malley (Salesperson, Long and Foster
Real Estate, Inc.) License SUSPENDED for twenty
days for violation of §17-322(b)(25), (32), and (33), §17-532(c)(1)(iv),
and COMAR 09.11.01.01C and 09.11.02.02A for failing to raise
with her client the buyer the issue of having an inspection
of the inside of the property and for failing to reduce
to writing the seller's agreement to give the buyer monies
from the settlement to make repairs to the property.
2004-RE-185 - William Newsome (Salesperson, Long & Foster
Real Estate, Inc.) agreed to SUSPENSION of his license
for forty-five days and to pay the complainant $10,600,
for violating § 17-322(b)(22), (25), and (32), and §17-530(b),
and COMAR 09.11.01.12, 09.11.02.01C and H, and 09.11.02.02A,
for failing to prepare a written property management agreement,
failing to place the tenants' security deposit in escrow,
failing to obtain a signed listing agreement and an agency
disclosure form, ordering repairs made to the property without
the knowledge or consent of the owner, and employing an
unlicensed contractor to perform those repairs.
2004-RE-366 - Zhong Hui (John) Wang (Salesperson, Re/Max Metropolitan
Realty) agreed to a one-month SUSPENSION of his
license, a FINE of $5,000, and a payment of $22,000
to the complainant, for violation of § 17-322(b)(25)(as
to improper dealings only) and (33), §17-502, and §17-532,
and COMAR 09.11.02.01C and 09.11.02.02A by failing to submit
trust money to his broker for deposit in the broker's trust
account, returning the deposit checks to the buyer without
the knowledge or consent of the seller, and misrepresenting
the disposition of the deposit monies to the seller's agent.

2004-RE-119 - Denise Seales-McLeod (Salesperson, Best Properties,
Inc.) Licensee FINED $5,000 and REPRIMANDED
for violation of §17-322(b)(3), (4), (6), (8), (15), (21),
(22), (25), (30), (31), and (33); § 17-502(a), § 17-530(b),
(c), and (d); § 17-532 (c)(1) (iii), (iv), (v), and (vi);
and COMAR 09.11.02.01C and D, and 09.11.02.02A for guaranteeing
future profits from the resale of property, failing to disclose
that she was representing both parties to the transaction,
failing to obtain consent of the parties for her broker
to act as a dual agent, failure to comply with the dual
agency law, failing to account for trust monies, receiving
a commission from someone other than her broker, failing
to provide copies of documents to the parties, leasing the
property without the consent of the owner, and failing to
advise her broker of the transaction.
2004-RE-317 - German Pena (Broker, HomePro Realty) agreed to
a FINE of $500, a REPRIMAND, and completion
of a course in real estate ethics in addition to the course
hours required for renewal of his license, and payment of
$3,000 to the complainant, for violation of § 17-322(b)(22)
by failing to disburse deposit monies after a release agreement
was signed.
2005-RE-158 - Frank Soltis (Broker, For Sale By Owner Real Estate
Services) agreed to a FINE OF $2,500, a REPRIMAND,
and to completion of courses in real estate ethics and principles
of real estate agency in addition to the course hours required
for the renewal of his license, for violation of § 17-322(b)(6)
and §17-530(d)(1)(ii) by acting as the agent for both the
buyer and seller in the transaction without designating
other agents to act as intra-company agents on behalf of
each of the parties.
2003-RE-259 - Norman H. Stafford (Salesperson, Baldus Real Estate,
Inc.) Licensee FINED $2,500 and REPRIMANDED
for violation of § 17-322(b)(25), (32), and (33), and §17-532(c)(iv)
and (vi), and COMAR 09.11.02.01C by failing to notify the
seller that the buyer's deposit check had bounced and had
not been replaced as promised. A Guaranty Fund payment in
the amount of $7,000 was made as a result of the conduct
of the licensee.

2005-RE-275 - Frank Calcara (Broker, Homeowners Realty) Licensee
FINED $10,000 for violation of §§17-317, 17-320,
17-322(b)(22), (25), (31), (32), and (33), 17-507, 17-517,
17-519, 17-520, and 17-530, and COMAR 09.11.01.07, .10,
and .13, 09.11.02.01C and .02A, and COMAR 09.11.08.01 for
failing to maintain a proper office, and display signs and
licenses, failing to report changes in affiliations and
in his office location, failing to properly secure and remit
escrow account funds, engaging in dual agency without the
written consent of the parties, and engaging in conduct
that displayed bad faith and untrustworthiness.
2005-RE-208 - Robert Coulter (Salesperson, Advance Realty, Inc.)
agreed to a FINE of $250 and to completion of a
course in the rules or principles of real estate agency
in addition to the course house required for renewal of
his license, for violation § 17-530(c) and (d)(1)(ii) by
acting as an agent for both the buyer and the seller of
the property.
2004-RE-303 - Cara Fetner (Salesperson, Long and Foster Real
Estate, Inc) Licensee FINED $1,000 for violation
of §§ 17-322 (b)(32) and 17-532(c)(1)(iv) for failing to
answer truthfully a question about a listed property that
was posed to her by the buyer.
2004-RE-343 - Selma D. Jager (Salesperson, Century 21 H.T. Brown
Real Estate) agreed to a FINE of $500 for violation
of § 17-532(c)(1)(iv) and (vi) for failing to identify the
appropriate person to sign the listing agreement and to
enter into a contract to convey the property on behalf of
the deceased owner.
2004-RE-323 - Lisa M. Kleeberg (Salesperson, Re/Max Exclusive)
Licensee FINED $500 for a violation of §17-322(b)(19),
(32), and (33) and §17-527.2(b) for publishing misleading
advertisements, failing to provide in an advertisement the
trade name of the real estate brokerage company with whom
the agent was affiliated, advertising properties without
the listing agent's knowledge or consent, and failing to
cooperate fully with the Commission in its investigation.
2004-RE-308 - Michael E. McGreevy (Associate Broker, Long &
Foster Real Estate, Inc.) agreed to a FINE of $2,000
for violation of §17-322(b)(31) and §17-502(a) by failing
to ensure that a good faith deposit was deposited into the
escrow account of his broker.
2005-RE-300 - Virginia Meeks (Salesperson, Long & Foster
Real Estate, Inc.) agreed to a FINE of $1,000 and
to completion of a course in rules or principles of real
estate agency in addition to the course hours required for
renewal of her license for violation of § 17-530 by designating
herself as the intra-company agent for both the buyer and
the seller.
2005-RE-429 - Wanda M. Perry (Broker, Sky's the Limit Realty
LLC) agreed to a FINE of $250 for violation of §
17-322(b)(27) and (33) and COMAR 09.11.01.13 by failing
to exercise reasonable and adequate supervision over the
provision of brokerage services by a salesperson affiliated
with her brokerage and failing to maintain records of real
estate transactions in her real estate office.
2005-RE-064 - Charles B. Ritch (Salesperson, Mr. Lister Realty,
Inc.) agreed to a FINE of $1,000 and to completion
of a three-hour course in agency in addition to the course
hours required for renewal of his license, for violation
of § 17-530(c) and (d) by acting as a dual agent in a transaction
without having a second agent designated by the broker to
act as an intra-company agent on behalf of the buyer.
2004-RE-124 - David H. Thomas (Broker, EZ Home Realty) agreed
to a FINE of $500 for violating § 17-322(b)(33)
and COMAR 09.11.02.02A by failing to protect and promote
the interests of clients with whom he had a buyer broker
agreement.
2002-RE-165 - Jeffrey Underwood (Broker, Uncommon Realty) agreed
to a FINE in the amount of $5,000, to pay $1,725
to the complainant, and to completion of a 3-hour ethics
class in addition to the course hours required for renewal
of his license, for violating §17-322(b)(25)(as to improper
dealings only), and (30), and § 17-530(b), by failing to
provide a written disclosure notifying the buyer that he
was acting as a real estate broker representing the seller
in the transaction.
REPRIMANDS
2005-RE-302 - Charles M. Gregg (Associate Broker, Re/Max Chesapeake)
agreed to a FINE of $1,000 and to a REPRIMAND
for violation of §17-322(b)(19) and (20) by placing an advertisement
claiming that he was the broker of a specific real estate
brokerage, when in fact he was not, and listing in the advertisement
names of licensees affiliated with that brokerage that were
different from the names that appeared on their licenses.
2004-RE-369 - Michael Haskell (Salesperson, Haskell & Associates,
Inc.) agreed to a REPRIMAND for violation of §17-532(c)(1)(vi)
by failing to exercise reasonable care and diligence in
returning his client's telephone calls in a timely manner
after the ratification of a contract of sale.
2004-RE-310 - Angela Mairs (Broker, Re/Max One) agreed to a
REPRIMAND for violation of §17-332(b)(31) and §17-502(b)
for failing to ensure that trust monies were deposited into
her broker escrow account within seven business days after
contract acceptance by the parties.
2003-RE-373 - Chianugonum Okocha (Salesperson, Best Properties,
Inc.) agreed to a REPRIMAND, to pay the complainant
$1,000, and to complete a 3-hour ethics class in addition
to the course hours required for renewal of his license,
for violating §17-322(b)(4), (25), and (32) and §17-532(c)(1)(iv)
and (vi), by failing to notify the seller of the return
of the deposit check for insufficient funds, and instead
seeking and receiving a two-month extension of the settlement
date.
2005-RE-015 - Zhong Hui (John) Wang (Salesperson, Re/Max Metropolitan
Realty) agreed to a REPRIMAND and to pay the complainant
$21,000, for violating §17-322(b)(33) and COMAR 09.11.02.01.12
and 09.11.02.01D by failing to ensure that a listing was
in writing, failing to notify his broker of the listing,
and failing to make a reasonable effort to obtain all material
facts concerning a property for which he had accepted the
listing.
2005-RE-451 - Zhong Hui (John) Wang (Salesperson, Re/Max Metropolitan
Realty) agreed to a REPRIMAND and to pay the complainant
$20,000 for violation of § 17-322(b)(33) and COMAR 09.11.01.12
and 09.11.02.01D by failing to obtain a written listing
agreement, and failing to make a reasonable effort to obtain
all material facts concerning the ownership of the property.
