Senate Bill 23 and House Bill 109, Elevator Safety Review Board - Membership
House Bill 89, Lift Mechanics Licensure
During the 2012 session, Senate Bill 23, Elevator Safety Review Board - Membership was introduced by Senator
Reilly. In addition to this bill two more bills were introduced. House Bill 109 was introduced by Delegate Vitale
would add one new member representing renovators. Effective date: October 1, 2012.
House Bill 89 was introduced by Delegate Stifler, et. al. provides for the licensing and regulation of lift
mechanics. This Act shall take effect January 1, 2013. The Board may issue a conditional license effective until
January 1, 2017, to a candidate actively completing the educational requirements as described in paragraph (1) (II) 2.
Senate Bill 232, Elevator Safety Review Board - Licensing
Senate Bill 232, introduced by Chair, Finance (By Request - Departmental Labor Licensing and Regulation) for
the purpose of requiring the Elevator Safety Review Board to provide a certification of licensure on request of
any person and payment of a fee set by the Board; reinstatement of a licensee for any reason, has failed to renew
the license and the Board shall consider the facts in the granting, denial, renewal, suspension, or revocation
of a license or the reprimand of licensee when an applicant or licensee fails to inform Board under the laws of
the United States or of any State has been convicted of a felony or misdemeanor. Effective date: October 1, 2012.
House Bill, 1094, Elevator Mechanics and Elevator Contractors
Senate Bill 515, Elevator Renovators
House Bill 1094, Chapter 703 of 2001 established elevator contractors and mechanics categories under the
Elevator Safety Review Board. By 2002, the Board proposed action to adopt new regulation .01 under a new chapter,
COMAR 09.35.01 General Regulations, under new Subtitle 35, Elevator Safety Review Board. The purpose of this
action provided the fee structure for elevator contractors and elevator mechanics.
Senate Bill 515, Chapter 254 of 2003: Emergency Bill, established elevator contractor and elevator renovator
mechanic licensure categories under the Elevator Safety Review Board. The law also defined elevator interior renovation.
The Board promulgated regulations for Elevator renovator contractors and mechanics; COMAR 09.35.02 -.03, to
define the qualifications and scope of practice. On April 20, 2012, the Elevator Safety Review Board adopted
COMAR 09.35.02 -.03. This action, which was proposed for adoption in 39:3 Md. R. 272 - 274 (February 10, 2012),
has been adopted as proposed. Effective date: July 9, 2012.
