MOSH Standards Notice 03-3 - Maryland Occupational Safety and Health (MOSH)

A.    Background

1.  On November 7, 2002, OSHA issued a final rule amending its occupational safety and health standards relating to Means of Egress. This final rule changes the name of the subpart from “Means of Egress” to “Exit Routes, Emergency Action Plans, and Fire Prevention Plans” to better describe the contents.  OSHA evaluated the National Fire Protection Association’s Standard 101, Life Safety Code, 2000 Edition (NFPA 101-2000), and determined that the standard provides comparable safety to the exit routes standard. Therefore, employers who wish to comply with the NFPA 101-2000 instead of the OSHA standards for Exit Routes may do so.

2.  On June 17, 2003, the Commissioner of Labor and Industry adopted through incorporation by reference under COMAR 09.12.31 Maryland Occupational Safety and Health Act – Incorporation by Reference of Federal Standards, the revisions under 29 CFR 1910.33 – 1910.39, 29 CFR 1910.119 – 1910.120, 29 CFR 1910.157, 29 CFR 1910.268, 29 CFR 1910.272, 29 CFR 1910.1047, and 29 CFR 1910.1050 – 1910.1051 relating to Exit Routes, Emergency Action Plans, and Fire Prevention Plans.

B.   Action

1.  MOSH Compliance personnel will enforce the adopted changes as provided in Attachment A.

2.  MOSH Supervisors will hold appropriate training sessions in each region to review the standard's requirements.
