How to File a Discrimination Complaint - MOSH

  1. You must file a complaint in writing with the:
    Assistant Commissioner for MOSH

    Division of Labor and Industry

  2. You may also file a complaint, either orally or in writing, with the:
    U.S. Department of Labor
    Occupational Safety and Health Administration
    200 Constitution Avenue, N.W.
    Washington, D.C. 20210

  3. Your complaint must be filed within thirty (30) days of the act of discrimination. You cannot wait for the result of a related safety and health enforcement action or grievance process before filing your complaint.
     
  4. Your complaint must include the following information:
    • Complainant's name, address, and telephone number;
    • Employer's name, address, and telephone number;
    • Date of the alleged act of discrimination;
    • Description of the safety and health condition involved;
    • Statement of the adverse action taken against the complainant; and
    • Complainant's Signature.
       
  5. The complaint must be related to an occupational safety and health issue.
    • Race discrimination and sex discrimination are NOT covered by the MOSH Act. These and many other types of employment discrimination, including discrimination as a result of a handicap, fall under the jurisdictions of the State of Maryland Commission on Human Relations, 6 Saint Paul Street, Baltimore, Maryland 21202, 410-767-8600,  and the U.S. Equal Employment Opportunity Commission, 1801 L Street, N.W., Washington, D.C. 20507, 202-663-4900.
    • Complaints about being fired for filing a Workers' Compensation claim or for being injured on the job are NOT covered by the MOSH Act. These issues fall under the jurisdiction of the Maryland Workers Compensation Commission, 10 East Baltimore Street, Baltimore, Maryland 21202-1641, 410-864-5100.
       
  6. Filing a MOSH complaint to request an enforcement inspection of a specific safety or health problem in the workplace is NOT the same as filing a MOSH discrimination  complaint. If you believe your employer has discriminated against you, you must file a separate discrimination complaint within the thirty day period required by law.

Su queja debe ser presentada dentro de treinta (30) días después del acto de discriminación. No puede esperar el resultado de una acción de cumplimiento relacionada de seguridad y salud ni un procedimiento conciliatorio antes de presentar su queja.

Su queja debe incluir la siguiente información:

La queja debe ser relacionada con un asunto de seguridad y salud ocupacional.

  • La discriminación racial y de sexo NO están cubiertas por la ley MOSH. El presentar una queja a MOSH para solicitar una inspección de cumplimiento por un problema específico de seguridad o salud en el lugar de trabajo NO es lo mismo que presentar una queja de discriminación MOSH. Si usted cree que su empleador le ha discriminado, debe presentar una queja de discriminación separada dentro del plazo de treinta días requerido por la ley.
